| **Return
Information** |
| All returns will
be subject to a 15% restocking fee, unless the return is due to a manufacturing
defect, or an error on the part of 'Desirewear' or one of its suppliers.
All items must be returned in NEW, UNUSED condition in the NON-DAMAGED
original manufacturer’s packaging. Damaged packaging will result in a $5.00
box fee. Returns bearing obvious signs of use will not be accepted. If
you need to make a return, you must notify 'Desirewear' within 7 days of
receiving you order. Failure to notify 'Desirewear' within the 7 day period
will result in refusal of your return. The cost of shipping and handling
is NON-REFUNDABLE unless the return is due to a manufacturer's defect or
an error on the part of 'Desirewear' or one of it's suppliers. You will
be responsible for the cost to ship returned items, which are in USED condition,
back to you. All returns must have a Return Merchandise Authorization (RMA)
number, issued by 'Desirewear', or they will not be accepted. Items returned
without a RMA number will be returned at your expense. When you notify
‘Desirewear’ to make a return you will be issued a RMA number. The RMA
number must be clearly written on the outside of the package you send to
us. Do not write on the manufacturer’s packaging. Any markings made to
the manufacturer’s packaging will be considered damage, which will result
in a $5.00 box fee. Once you receive the RMA number you have 7 days to
return the item to ‘Desirewear’. Any packages received after the 7 day
period and/ or without the appropriate RMA number written on the outside,
will be returned to the sender at his/her expense. Allow 2 weeks for returns
to be processed. Authorized returns, which meet the above criteria, will
result in a refund of the original purchase price by the same payment method
used to make the original purchase, less a 15% restocking fee if the return
is for any reason other than manufacturer’s defect or error on the part
of ‘Desirewear’ or its suppliers. Returns will not be accepted on clearance
items. Returns must meet the above criteria to be eligible for a store
credit. The 15% restocking fee will be waived on returns made for store
credit. Excessive returns for store credit, as determined by ‘Desirewear’,
will be charged a 15% restocking fee. All refused shipments will result
in a 15% restocking fee in addition to all shipping costs incurred. Failure
to pay fees, costs, etc., mentioned in the above terms, which are assessed
to your account will result in permanent termination of your account and
collection proceedings. |

| ‘Desirewear’ nor
any of its employees, affiliates, and/ or owner will be in anyway liable
for any accident, injury, destruction, damage, consequences, cost, loss
and/ or liability, bodily and/ or otherwise, directly and/ or indirectly
resulting from purchase, shipping, delivery, return, use, and or misuse
of any of our product(s) and/ or service(s). Any buyer(s), purchaser(s),
and/ or user(s) of any product(s) and/ or service(s) offered by ‘Desirewear’
agrees to release ‘Desirewear’ and any and/ or all of its employees, affiliates,
and/ or owner from any and all liabilities, financial responsibilities,
legal responsibilities, repercussions, and/ or actions listed above and
those which may not be listed but would in any way involve ‘Desirewear’
and/ or any of its affiliates, employees, and/ or owner. Any purchase(s)
and/or use of any item(s) and/ or service(s) offered by ‘Desirewear’ will
act as an absolute agreement, on the part of the buyer(s), purchaser(s),
and/ or user(s) of the item, with any and all of the above terms and/ or
conditions. |
